Dulion v. Hart

Plaintiff brought an arbitration proceeding in the American Arbitration Association against elderly defendant clients for breach of contract, fraud, violation of the statute, and breach of fiduciary duties. Essentially, the plaintiff alleged that the defendants had sold him a house and had failed to disclose during the transaction all of the defects in the home that they should have allegedly discovered. The plaintiff sought damages in the sum of $35,000 and attorneys fees and costs. The defendant’s clients denied that they failed to disclose any defects in the home. The case went to binding arbitration before an attorney. The arbitrator ruled that the defendant had done nothing wrong in connection with the sale of their home and had made all proper disclosures. The defendants were awarded attorneys fees and costs in the sum of $26,000 by the arbitrator.
