Andres v. Schmetzer

Claim brought by foreign trustee from Germany against foreign clients who resided here to recover over $800,000 in assets that trustee claimed belonged to estate in Germany that had filed for bankruptcy in Germany.  The Trustee claimed that our clients murdered the husband of one of my clients.  The autopsy report which also included an analysis of the crime scene concluded that the husband had committed suicide after being despondent over large losses he suffered in the stock market in October of 1987. Used German substantive and probate law, the Federal Rules of Civil Procedure and California Civil Procedure to handle case.  Also, coordinated proceedings here with court proceedings being handled in Germany.  Obtained a court order dismissing case against clients and recovered for clients their court costs.
