Studwell Inc. v. Pacific Economic Dev. Corp.

Our client brought an action against the defendant for breach of contract and common counts.  Our client claimed that the defendant failed to pay it $190,000 due and owing to it for engineering services that it provided for a gantry mill planer machine owned by the defendant's client.  The defendant answered the complaint, denied its allegations and cross-complained against our client for $250,000. Essentially, the defendant contended our client failed to properly and timely perform its obligations under the written contract.  

The case was heard by Judge Fleming, a retired court of appeal judge. After considering all the evidence, the court granted judgment in favor of our client in the sum of $300,000 which included the principal amount due our client, accrued interest, court costs and attorneys fees. The defendant's recovered nothing on its cross-complaint.
